Terms of Sale

This section describes the terms of sale for all orders and purchase transactions on bobcphotography.com (“this Site”).
Where We Sell
At present we sell and ship to the contiguous 48 U.S. states. Sales to Alaska, Hawaii, U.S. territories or other countries can be arranged at additional cost and additional delivery time. Sales to locations outside of the 48 contiguous U.S. states can be arranged via a custom order.

Pricing
Our prices are listed in U.S. dollars and all of our sales transactions are conducted in U.S. dollars. Our current pricing is based on our standard ordering, payment and shipping processes. Our standard processes currently support orders from and shipments to the 48 contiguous U.S. states. Sales outside of the 48 contiguous U.S. states will require a custom order and will incur additional charges and perhaps additional delivery time.
Dynamic Pricing
We do not engage in dynamic pricing, also known as surge pricing or demand-based pricing, under any circumstances. While our web hosting service does use “cookies” for analytical purposes, we do not, under any circumstances, track the shopping history of our customers and site visitors for pricing purposes. The prices one customer sees for our print products are the same prices that all customers and site visitors see.
Ordering
Customers are fully responsible for providing complete and correct customer, shipping and payment information when submitting an order with bobcphotography.com. We do not accept PO boxes for shipping addresses. We assume no responsibility for mis-deliveries due to incorrect ordering information provided by a customer. All ordering and shipping information provided to bobcphotography.com is governed by our Privacy Policy.
We reserve the right to refuse or a cancel any order at any time. When bobcphotography.com refuses or cancels an order the customer’s sole remedy is a refund of any payment(s) made for the cancelled or refused order.
Cancellations and Changes
Production of prints purchased from bobcphotography.com is a costly and custom process for every order and that process can begin immediately after the order has been placed. Therefore all changes or cancellations to print orders during production are subject to a 50% cancellation fee. Orders that have been shipped or delivered cannot be changed and are non-cancellable, non-returnable and non-refundable.
Payments
Full payment is due at the time of purchase on all print orders, though customers using Squarespace Payments at checkout can use Klarna to finance purchases if they qualify. We accept Visa, MasterCard, American Express and Discover cards through Squarespace Payments or PayPal. We also accept payments through Google Pay if customers have a Google Pay account and are using a Chrome browser to access our site.
Sales Tax
We charge flat-rate sales tax in Arizona and Nevada.
At present we don’t charge sales tax in U.S. states other than Arizona or Nevada or in in the District of Columbia. When our level of business in the District of Columbia or a U.S. state outside of Arizona and Nevada reaches that state’s nexus threshold, we’ll begin charging sales tax in that state.
If you purchase a print from bobcphotography.com in Arizona or Nevada, we will analyze your local sales tax rate against our nominal sales tax rate for your state. If your local sales tax rate is higher than our nominal tax rate, we will pay the difference. If your local sales tax rate is lower than our nominal rate by more than $20, we will refund the difference to you.
We Accept Resale Certificates from Qualified Buyers
If you are a third party interior designer, art advisor or gallery owner in a state or region where we charge sales tax, and you plan to resell prints you purchase from bobcphotography.com and you have a resale certificate for the state in which you will be reselling the prints you purchase from us, we will honor that certificate and not charge sales tax. As a third party reseller you may also be eligible for a reseller discount. Please contact us at info@bobcphotography.com or at (520) 238-9945 to arrange for a reseller or tax-exempt purchase.
Production and Delivery
Production of every print order starts as soon as possible after the order has been placed. Please allow 6-8 weeks for delivery of all standard print orders, and longer for custom orders and orders placed from locations outside of the 48 contiguous U.S. states.
Shipping
Due to the large and unusual sizes of our prints, our standard shipping method is (ground) freight to the 48 contiguous U.S. states. Standard shipping is free to customers. Expedited shipping or shipping to locations outside of the 48 contiguous U.S. states can be arranged at additional cost via a custom order. Please contact us at info@bobcphotography.com to arrange for expedited shipping or shipping to destinations outside of the 48 contiguous U.S. states.
Limited Warranty
All of our acrylic-backed acrylic prints carry a limited lifetime warranty against defects in materials and workmanship. This warranty excludes accidental damage, damage due to mishandling, normal wear and tear or failure to properly maintain the print. This warranty is non-transferrable and applies only to the original owner. We pay for standard shipping of warranty replacements; standard shipping means ground freight shipping to locations in the 48 contiguous U.S. states. The customer pays for non-standard shipping of warranty replacements; non-standard shipping includes expedited shipping and shipping to locations outside of the 48 contiguous U.S. states.
Color Rendition
Colors, brightness levels and contrast levels seen on a computer monitor may not perfectly match the color, brightness and contrast characteristics of a produced print. Therefore we make no guarantee that any image shown on our website will perfectly match the produced print.
Inspection upon Delivery
Customers are responsible for ensuring that their print order has been delivered properly and that the order is not damaged or defective. Customers are responsible for carefully unpacking their print orders and inspecting the order immediately upon delivery. Notification of shipping defects or damage or production defects or damage to purchased prints must be made to bobcphotography.com within 7 days of delivery and must be accompanied by photographic evidence and a copy of the shipping receipt or packing slip. Otherwise the print will be deemed to be accepted. Please contact us at info@bobcphotography.com to notify us of shipping damage or production defects.
Copyright and Reproduction
All Copyright rights, including, without limitation, all reproduction and trade dress rights associated with prints and other reproductions of images originated by Robert Cuckler and bobcphotography.com are retained by Robert Cuckler and bobcphotography.com. Sales of prints by bobcphotography.com do not include a sale or license of the Copyright to the purchaser. The purchaser is not authorized to reproduce or copy the print or its original image without advance written permission from Robert Cuckler. Robert Cuckler’s signature and the copyright notice as they appear on or about the print or reproduction at the time of sale must not be removed or concealed. Robert Cuckler shall receive authorship credit in connection with the print or reproduction at all times.
